Only if you can prove that the pool owner was negligent in maintaining his pool. For example, if you believe the pool owner failed to properly maintain chlorine levels and that was the contributing factor to the contamination that caused your injury, then you may have a case. You will need expert testimony to prove that the pool owner did not act in a reasonable manner in maintaining the chlorine levels in the pool. If you are successful, the judge can award you damages for the pain you suffered from your injury. Make sure that you did not sign a waiver and release of liability form releasing the pool owner from liability. Sometimes, when you go swimming in a public swimming pool, you are required to sign a release and waiver before you are allowed to use the pool.
